Gov. Beshear Grants 197 Pardons, 6 Commutations
Cheryl McCafferty. Via WCPO.com. |
FTM broke the story that McCafferty could be let out early (listen to that podcast here) but with the pardon by Beshear, she will be let out immediately.
So what does the pardon mean for McCafferty?
A pardon is an act of the Governor whereby a person is forgiven of a crime. If the person is still serving a prison sentence, that penalty is no longer in effect and the person will be released immediately. Any restrictions placed on ex-convicts do not apply to the pardoned person.
That being said, a pardon does not erase a conviction. The conviction remains on your criminal record and must be disclosed in any situation where information about past criminal activity is required. This is different from an expungement, which would mean that the crime never existed.
Throughout his 8 years in office, Gov. Beshear received more than 3,400 requests for pardons that were reviewed over several months by the Governor and his staff.
“I spent many long days weighing the merits and circumstances of individual cases before making my final decisions,” Gov. Beshear said. “The pardon authority afforded me by Section 77 of the Kentucky Constitution isn’t something I take lightly. We are talking about action that impacts the lives of so many individuals.”
Among the actions taken today by Gov. Beshear were commutations of sentence or full pardons to 10 women sentenced for violent crimes they committed.
“These 10 women – some of whom are currently incarcerated and some of whom have already been released from institutions – were recommended to me for consideration for full pardons after an extensive joint review by the Department for Public Advocacy and the Kentucky Domestic Violence Association,” Gov. Beshear said. “After further review of those files, I determined that some of the pardon requests should be granted, while others merited a commutation of sentence.”
A full list of pardons are listed below:

This is disgusting!
ReplyDeleteWhy do we have a justice system when a single individual can wipe out everything with his signature. He apparently knows better than the juries put in place who convicted these individuals. Pathetic, cowardly act by a completely ineffective governor!
ReplyDeleteHer sentence was not the result of a jury verdict.
DeleteIt doesn't wipe out everything. She still has murder on her record.
Delete#1 u have no idea exactly what the story is behind these charges. Some of these could be battered women who only out of self defense killed their husbands where their only choice was to kill or b killed. Until u have lived their life u have no room to judge them!
ReplyDeleteHer husband was asleep when she pulled the trigger. She could have walked away. She got away with murder.
ReplyDeleteRemember if that ever happens to you and how hard it would be to walk away and having to look over your shoulder constantly. I think Snodgrass should let it go. It looks like she has a personal vendetta against her. I wish she would be this outspoken about all the other cases she's tried. She was getting out early anyway.
ReplyDeleteWow!
ReplyDeleteMy father was murdered when I was 12 by my step mom...... I have spent yrs battling this and I used to hate her I myself have never been a victim of physical abuse my father was abusive to her.... But I can honestly say when someone's mind is torn and emotionaly unstable they will do things they would usually never think of..... So who r we to judge... Why or what happened ....
ReplyDeleteShe didn't get away with murder. She was convicted in a court of law.
ReplyDeleteNo she didn't get away with anything she served time n it's still on her record. Kentucky closed their woman facilities n they have no where to house them so he is letting them out. It's all about money.
ReplyDelete
